Jana obrt enables the use of the services and content of the website www.nails-jana.com which is governed by these Terms of Use (hereinafter: the Terms). Using Jana obrt web shop ordering system and all associated sites and services belonging to the domain www.nails-jana.com (hereinafter: Jana web shop) are considered to be users at all times to be familiar with these Terms, and to fully understand and accept them.

Jana obrt does not guarantee that this website will be available without interruptions or errors or without any security issues. To the extent permitted by the law, Jana obrt excludes liability for any losses, damages or inconveniences that may arise from the use of the website or the web shop.
Using the website or ordering through the web shop is allowed only for placing valid inquiries and orders, whereby the submission of false or fraudulent orders is prohibited. If there is a reasonable suspicion that the order is fraudulent, false or stated by a minor Jana obrt reserves the right to cancel the order and notify the competent institutions.

5. Registration
By registering through the Jana obrt web shop, the user acquires the right to their own user profile through the e-mail address and password selected during registration. User accounts are personal and non-transferable. User accounts created for legal entities may only be used by the responsible person specified during registration.
The user is solely responsible for the accuracy, truthfulness, completeness and up-to-dateness of all information provided during registration and during orders. In the event of any change in the specified data, the user is obliged to update his user profile in a timely manner.
If Jana obrt determines that the data provided is inaccurate, untrue or misleading, or that the user profile is used contrary to these General Terms and Conditions, it reserves the right to suspend or remove the user profile and related services without prior notice.
6. Obligations of registered users
During the registration process, the user must select the type of registration (natural person or legal entity) and provide the following information:
- natural persons: name and surname, address, postal code and city, e-mail address and desired password;
- legal persons: company, name and surname of the legal representative, address, postal code and city, e-mail address, desired password and ID number.
The registered user is solely responsible for maintaining the confidentiality of his access data, including his e-mail address and password. All activities carried out through the user profile will be considered as the activities of the user himself.
The registered user is obliged to notify Jana obrt without delay of any suspicious or unauthorized access to his account or any other security incident.
7. Terms of online sales
a) Product Information
Jana craft offers for sale cosmetic items and formulations.
Product images are for illustrative purposes only, and cannot always correspond to the ordered products in all details. Jana craft does not guarantee full compliance of the colors of the product with the colors as the user sees them on the screen of his monitor.
Also, Jana obrt reserves the right to change, suspend or temporarily discontinue the provision of distance product sales services in whole or in relation to individual products.
b) Order
The Jana Nails product catalog can be accessed at any time via the website www.nails-jana.com.
The order of the product can be made electronically. Pressing the "Add" button adds the selected product to the shopping cart. The selected product is ordered after selecting by pressing the "Order" button and completing the process of online selection of the desired products.
Upon completion of the order, Jana craft will contact the customer, via email, to deliver an order confirmation, information that the order cannot be executed and/or an invoice for payment for the product. The purchase contract is considered concluded after the buyer has made the payment for the ordered products. These General Terms and Conditions are considered an integral part of the purchase contract.
All product orders are subject to availability. Jana craft tries to ensure the availability of all products, but there may be deviations in the quantity and availability of certain products. If Jana craft is not able to deliver the ordered product or the ordered quantity of the product, it will offer the customer an order of a similar replacement product, partial delivery or will reject the order.
Jana obrt sells its products in certain territories outside the Republic of Croatia through exclusive distributors. A list of Jana Nails exclusive distributors is available here.
c) Delivery and collection of products
The product delivery service is performed on the territory of the Republic of Croatia and in third countries where Jana obrt does not have appointed exclusive distributors. A list of territories where Jana crafts does not deliver is available here.
Jana craft does not independently perform the delivery service, but it is provided through subcontractors. The products are delivered as soon as possible, and the customer will be informed about the exact delivery date when receiving the product purchase confirmation.
It is common for products purchased by 3:00 p.m. to be shipped on the same working day, and arrive at the delivery address within 48 hours. In the case of purchases on Friday after 15:00 as well as during weekends, holidays or non-working days, the products will be sent on the following working day.
Delivery is free of charge in the territory of the Republic of Croatia for all purchases of products worth more than EUR 66.36. A fee of EUR 5.00 is charged for the delivery of products whose value is less than the stated amount, regardless of the value of the product. Deliveries outside the Republic of Croatia are calculated according to the valid price list of delivery services and are charged regardless of the value of the purchase of the product.
Delivery may be disabled or delayed due to reasons such as force majeure, closed roads, difficult weather conditions, interruption of ferry lines, etc. In this case, Jana craft will make all reasonable efforts to deliver the product, contact the customer in a timely manner and arrange an alternative date as well as the delivery method.
If for any reason the customer was not available at the delivery address or via the indicated contact number, Jana obrt is not responsible for extending the delivery times.
If within 30 days from the date of availability of the order for delivery it was not possible to make the delivery for reasons for which Jana obrt is not responsible and the buyer did not subsequently contact Jana obrt, it is considered that the buyer terminates the contract for the purchase of products. As a result of the termination of the contract, the buyer is entitled to a refund of the amount of the value of the purchased product.
The products will be packaged in such a way that they cannot be damaged by normal manipulation in transport. When taking over the product, the buyer is obliged to check for possible damages and defects, and in case of their existence, note the damages and defects on the delivery note.
In the event the customer opts for personal pick-up of the products, the package can be handed over at the location Grižanska 33, Zagreb, Republic of Croatia during working hours from Monday to Friday from 9 a.m. to 5 p.m. within three working days of order confirmation.
d) Price, payment and security of transactions
All product prices on the Jana Nails website are expressed in euros (€) and include VAT, but do not include the delivery price of the product. The price of the product is the one stated at all times on the Jana Nails website, except in the case of an obvious error. Jana obrt do everything to ensure that the prices listed on the Jana obrt website are correct, but there can always be an error. Jana obrt is not obliged to sell the product to the buyer at an erroneously stated lower price if the error in the price is obvious and unambiguous and the buyer could reasonably understand that the price is not correct. .
Prices, payment terms and special offers are valid only at the time of payment and are subject to change without prior notice.
Payment can be made via Maestro, MasterCard and Visa cards, general payment slips, internet or mobile banking, and cash on delivery.
The card payment system is integrated on the Jana Nails website. The entry and transfer of personal data and credit card number data is protected by the highest security standards provided by the Monri WSPay system for online credit card authorization in accordance with the requirements of card companies and card brands and PCI DSS standards. Authorization and collection of credit cards is done using the Monri WSPay system for authorization and collection of cards in real time. Card and owner data are not stored on servers managed by Jana obrt. The order was made after the card has been successfully authorized. If the system refuses to authorise a card payment, you need to choose one of the alternative payment methods or contact the card issuer's bank. Jana obrt does not have access to information on the reasons for refusing card payment authorization.
Jana obrt uses Monri WSPay for online payments. Monri WSPay is a secure system for online payments, real-time payments, credit and debit cards, and other payment methods. Monri WSPay provides the customer and merchant with secure entry and transfer of entered card data, which is confirmed by the PCI DSS certificate that Monri WSPay has. Monri WSPay uses an SSL certificate with 256-bit encryption and TLS 1.2 cryptographic protocol as the highest levels of protection when writing and transferring data.
8. Termination of the contract and return of the product
a) The consumer's legal right to unilaterally terminate the purchase contract
Natural persons who purchase products through the web shop for their own needs (consumers) have the legal right to unilaterally terminate the purchase contract without giving a reason, all in accordance with the applicable Consumer Protection Act.
The consumer can express unilateral termination of the contract by an unambiguous statement sent by post, fax or e-mail to info@nails-jana.com, in which he will state his name and surname, address, telephone number, fax or e-mail address, and he can also use the attached example of the form for unilateral termination of the contract, which can be found here.
After the expiry of the period of 14 days, counting from the day on which the buyer or a person designated by the buyer received the purchased product, it is no longer possible to unilaterally terminate the purchase contract.
The possibility of unilateral termination of the purchase contract is excluded in the case where the subject of the purchase is a sealed product that is not suitable for return for health or hygiene reasons, if the product was unsealed after delivery or if the subject of the contract is perishable goods or goods that are about to expire. Also, the consumer is responsible for the depreciation of the product resulting from the handling of the product, other than that which was necessary to determine the nature, characteristics and functionality of the product. In the event of unilateral termination of the contract, Jana obrt undertakes to refund the purchase price to the buyer, including the paid shipping costs, without delay, and no later than 14 days from the date of receipt of the product. The refund will be made through the same means by which the Buyer made the payment.
The buyer is obliged to return the product that has been unused and in the original packaging, without delay, and no later than 14 days from the date of sending the statement on unilateral termination of the contract by the buyer.
The buyer bears the direct costs of returning the product to Jana craft in the event of exercising the right to unilateral termination referred to in this article.
b) Material defects
Jana obrt is responsible for material defects of the products it sells on its website in accordance with the positive regulations of the Republic of Croatia, especially the Civil Obligations Act. A material defect can be considered, for example, if the item does not correspond to the description, type, quantity and quality, i.e. if it does not have functionality, compatibility, interoperability and other features as determined in the purchase contract, if the product does not have the necessary properties for its regular use or for trade, if it does not have the necessary properties for the special use for which the buyer purchases it, and which was known to Jana obrt or should have been known to Jana obrt, etc.
The buyer has the right to complain in relation to material defects within the deadlines and for the reasons prescribed by the provisions of the Civil Obligations Act. If the Buyer is of the opinion that the product significantly deviates from the product displayed in the web shop or that it has defects due to which it cannot be used, the customer can contact Jana obrt at info@nails-jana.com.
When returning a product, Jana obrt bears the cost of returning the product only if the product is defective or damaged and if a product other than the one ordered by the customer was delivered. If the existence of a material defect is established, the buyer has the right to demand from Jana obrt the removal of the defect, replacement with a new product without defect, price reduction or termination of the contract, all in accordance with the Civil Obligations Act.
9. Consumer complaint
In accordance with the Consumer Protection Act, the consumer can always raise a complaint in writing or in person at the business premises at Jana obrt, Grižanska 33, 10000 Zagreb, by mail or e-mail at the address info@nails-jana.com.
Jana obrt undertakes to respond to complaints in writing within 15 days from the date of receipt of the complaint.
The complaint should contain the applicant's details, contact address and the content of the complaint.
10. Processing of personal data
By registering on the Jana obrt website, the user agrees that Jana obrt, as the personal data controller within the meaning of the General Data Protection Regulation, and its business partners, i.e. subcontractors, as processors within the meaning of the General Data Protection Regulation, collect, process, mutually forward and exchange the following data specified in the registration form and data on the user's orders.
The user can withdraw their consent at any time and delete their profile.
Jana obrt will provide the user with privacy and protection of personal data, passwords and all other details on its website in accordance with the Privacy Policy located here.
Jana obrt online store uses "cookies" in order for the website to work properly and during the purchase process so that the online store can recognize and remember the user and thus enable the realization of the purchase.
11. Limitation of Liability
All products available on the Jana obrt web shop are purely cosmetic in nature and are not intended to diagnose, treat, alleviate or prevent any disease. The information provided with the products (description, composition, instructions for use) is for informational purposes only and does not constitute medical advice.
Adverse reactions to individual ingredients of the product are always possible. The buyer is obliged to carefully read the declaration and composition of the product before use, especially in case of known allergies or sensitivities. It is recommended to test the product on a small area of skin before using it for the first time.
Jana obrt does not take responsibility for any damage, direct or indirect, that may arise from the use of the product contrary to the instructions, recommendations or declaration. It is also not responsible for damage caused by improper storage of the product by the customer or use after the expiration date.
Jana obrt cannot guarantee that the products will have the same effect on all users or customers, nor that they will meet all needs and expectations. In case of any health problems, the customer must consult a doctor.
The total amount of damages, regardless of the basis, is limited to the amount of the total order of the purchased products, to the extent that such limitation is in accordance with the laws of the Republic of Croatia. Any liability of Jana obrt in relation to lost profit is expressly excluded.
12. Applicable Law and Jurisdiction
These General Terms and Conditions shall be construed and applied in accordance with the laws of the Republic of Croatia, without regard to the conflict of law rules.
Any disputes, claims or disputes arising out of or related to these General Terms and Conditions shall be exclusively subject to the competent courts in the Republic of Croatia.
Jana obrt informs users that they are not obliged to participate in out-of-court dispute resolution procedures before alternative dispute resolution bodies. However, in case of disagreements, complaints or disputes, each buyer or user can contact Jana obrt via email info@nails-jana.com and it will be resolved amicably.
These General Terms and Conditions are effective as of their publication on the Jana Nails website from 09.10.2025.

Receipt and processing of orders
Orders are processed, prepared and sent as soon as possible, and we deliver packages in cooperation with GLS.
The delivery price is EUR 5,00 and is calculated on all orders with an amount less than EUR 66,36 and applies to the entire Republic of Croatia, while for orders of more than EUR 66,36 delivery is free.
The amount of delivery for countries outside the EU is calculated according to the valid price list of GLS and is charged regardless of the amount of the order.
Orders received by 3 pm are usually sent on the same working day, and on Your address will arrive within 24 - 48 hours depending on the time of receipt and sending orders, delivery zones (eg islands), etc.
Orders received on Friday after 3pm as well as on weekends will be shipped the first business day after weekends - usually Mondays. If the order was received during the holidays / non-working days / will be sent the first working day thereafter.
In exceptional situations caused by increased workload (due to discount / after non-working days / due to natural disasters / inability to do business due to disappearance electricity and similar contingencies that we cannot directly influence the package delivery deadline is extended according to the duration of the situation that has occurred.
Also, Jana Crafts is not liable for delays caused by the direct fault of GLS Delivery services that may occur due to emergency situations / natural disasters / technical failures, etc.
